This “Privacy Policy” describes how Halfdays Apparel Corp. and its subsidiaries and affiliates (collectively, “we”, “us”, or “our”) collect, use, and share your personal information in connection with our website at https://www.halfdays.com/ and any other websites we own and operate that link to this Privacy Policy (collectively, the “Site”), our emails and other electronic communications, our social media pages and community channels, and our related services, sales, marketing, and events (collectively, and together with the Site, the “Platform”), and the rights and choices available to individuals with respect to their personal information.

We may update this Privacy Policy from time to time. If we make revisions that change the way we collect, use, or share personal information, we will post those changes in this Privacy Policy. You should review this Privacy Policy periodically so that you keep up to date on our most current policies and practices.   1. COLLECTION OF PERSONAL INFORMATION

1.1.   Personal information you provide to us. Personal information you may provide to us through the Platform or otherwise includes:

  • Contact details, such as your first and last name, email address, phone number, and mailing address.
  • Account information, such as the email address and password that you use to establish an online account with us, your date of birth, and other information you provide in connection with your account.
  • Communications that we exchange, such as when you contact us with questions or feedback or otherwise communicate with us.
  • Your posts, reviews, and other content, such as messages that you post on social media or in our community channel, videos, images, or other materials that you submit (such as in response to a casting call), reviews that you leave for our products, and other content that you provide.
  • Preferences, such as your preferences for receiving communications about our products, services, activities, events, and publications, and details about how you engage with our communications.
  • Survey responses, such as the answers you provide to our questionnaires and surveys.
  • Order information, such as the products or services you purchase and your order history.
  • Payment and transactional information, such as credit or debit card information, billing address, and shipping details.
  • Job application information, such as your name, email address, LinkedIn profile, resume, and other information that you provide when you apply for a job with us through the Platform.
  • Other information that we may collect which is not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

1.2.   Personal information from third parties. We may obtain personal information about you from other sources, such as data providers (such as information services, marketing partners, and data licensors), public sources (such as social media platforms and our community channels), and business partners (such as joint marketing partners and event co-sponsors).

1.3.   Personal information collected automatically. We, our service providers, and our advertising partners may automatically log information about you, your computer or mobile device, and your activity over time on our Platform and other sites and online services, such as:

  • Device data, such as your computer or mobile device operating system type and version number, manufacturer and model, browser type, screen resolution, IP address, unique identifiers, the website you visited before browsing to our Site, and general location information such as city, state, or geographic area.
  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access.

Like many online services, we use cookies and similar technologies to facilitate some of the automatic data collection described above, such as:

  • Cookies, which are text files that websites store on a visitor‘s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising.
  • Web beacons, also known as pixel tags or clear GIFs, which are typically used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked, typically to compile statistics about usage of websites and the success of marketing campaigns.

1.4.   Referrals. You may have the opportunity to invite friends or other contacts to the Platform and share their contact information with us. Please do not provide us with someone’s contact information unless you have their permission to do so.

  1. USE OF PERSONAL INFORMATION

We may use your personal information for the following purposes and as otherwise described in this Privacy Policy or at the time of collection:

2.1.   To provide the Platform and our products and services. For example, we may use your personal information to:

  • provide you with the content, features, products, and services that you request;
  • establish and maintain your account on the Platform;
  • process your orders, send you receipts, and monitor your orders;
  • store your information for future orders;
  • remind you about items you have left in your shopping cart by sending you an email, text message, or other communication;
  • communicate with you about the Platform (including by sending announcements, updates, security alerts, and support and administrative messages);
  • display your content or share your information with other users or the public;
  • understand your interests, personalize your experience on the Platform, and deliver information about products and services relevant to your interests; and
  • respond to your inquiries and requests for customer support, including to investigate and address your concerns and monitor and improve our responses.

2.2.   For research and development. We may use your personal information for research and development purposes, including to study and improve the Platform and our business, understand and analyze the usage trends and preferences of our users, and develop new features, functionality, products, and services. As part of these activities, we may create aggregated, de-identified, or other anonymized data from personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes.

2.3.   For marketing and advertising. We, our business partners, and our third-party advertising partners may collect and use your personal information for direct marketing and interest-based advertising purposes.

  • Direct marketing. We may send you Halfdays-related or other direct marketing communications as permitted by law. You may opt-out of our marketing communications as described in the “Opt-out of marketing communications” section below.
  • Interest-based advertising. We also contract with third-party advertising companies and social media companies to help us advertise our business and to display ads for our products and services and other products or services that may be of interest to you on the Platform and other locations. These companies may use cookies and similar technologies to collect information about you (including the device data and online activity data described above) over time, across our Platform and across other sites and services, or about your interaction with our emails, and use that information to serve ads that they think will interest you. In addition, some of these companies may use hashed customer lists that we share with them to deliver ads to you and to similar users on their platforms. 2.4.   Compliance and protection. We may use your personal information to:

  • comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;
  • maintain the safety, security, and integrity of our Platform, products and services, business, databases, and other technology assets;
  • protect our, your, or others’ rights, privacy, safety, or property (including by making and defending legal claims);
  • audit our internal processes for compliance with legal and contractual requirements and internal policies;
  • enforce the terms and conditions that govern the Platform; and
  • prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activity, including cyberattacks and identity theft.

With your consent. In some cases, we may specifically ask you for your consent to collect, use, or share your personal information, such as when required by law.

  1. SHARING OF PERSONAL INFORMATION

We may share your personal information with the following third parties and as otherwise described in this Privacy Policy or at the time of collection:

3.1.   Business transaction participants. If we sell all or part of our business or make a sale or transfer of assets or are otherwise involved in a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Halfdays or our affiliates (including, in connection with a bankruptcy or similar proceedings), we may transfer your personal information to a third party as part of that transaction (or potential transaction), including at the negotiation stage.

3.2.   Related Companies. Our affiliates, subsidiaries, and other related companies.

3.3.   Authorities and others. Law enforcement, government authorities, and private parties, as we believe, in good faith, to be necessary or appropriate to comply with a law, to exercise a right or privilege, or for the other purposes described in the “Compliance and protection” section above.

3.4.   Service providers. Companies and individuals that provide services on our behalf or help us operate the Platform or our business. Among other things service providers may help us perform website hosting, maintenance services, database management, web analytics, billing, payment processing, shipping and fulfillment, fraud protection, or marketing.

3.5.   Advertising partners. Third-party advertising companies that collect information about your activity on the Platform and other online services to help us advertise our services and for the other purposes described above in the section titled “Interest-based advertising.”

3.6.   Business partners. Our business partners, such as those that jointly offer content, promotions, and other service offerings with us.

3.7.   Other Users and the Public. The Platform may provide you with the opportunity to post or make available content, messages, and other information to other users of the Platform or the public. For example, you may be able to post reviews on the Site or share content in our community channel. We do not control how other users or third parties use any personal information that you make available to them. Please be aware that any information you post publicly can be cached, copied, screen captured or stored elsewhere by others (e.g., search engines) before you have a chance to edit or remove it.3.8 Professional Advisors. Our professional advisors, such as lawyers, bankers, auditors, and insurers, such as when disclosing personal information is necessary in the course of the professional services that they render to us.

You can make the following choices with respect to your personal information.

4.1.        Access or update your personal information. If you have registered for an account with us, you may access and update or correct certain account information by logging into your account, such as your contact information and shipping details. You may also contact us at heythere@halfdays.com.

4.2.        Opt-out of marketing emails. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email and in some cases though your account. You may continue to receive service-related and other non-marketing emails.

4.3.        Opt-out of text messages. We may offer communications via text messages sent by Halfdays or any of our service providers, such as when we send you text messages to confirm and notify you about the status of an order you place with us, to remind you about items you have placed in your shopping cart (i.e., cart abandonment messages), or for any customer service, account-related, or marketing purpose. To stop receiving text messages from us, reply STOP to any text message you receive from us, or send your request and mobile telephone number to heythere@halfdays.com. Note that we may send you a message to confirm receipt of your STOP request.

4.4.        Cookies. Most browsers let you remove or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Platform and our Site may not work properly. We use services like Google Analytics to help us understand user activity and patterns on the Site. 4.5.        Advertising choices. Some of our advertising partners are members of the Network Advertising Initiative (NAI) and are subject to the Self-Regulatory Principles for Online Behavioral Advertising published by the Digital Advertising Alliance (DAA). You can obtain more information about these companies’ information collection practices and opt-out of receiving interest-based advertising from participating NAI and DAA members at http://www.networkadvertising.org/managing/opt_out.asp and/or the DAA’s website at www.optout.aboutads.info. You can also limit collection of your information for interest-based ads by blocking third party cookies in your browser settings or using privacy plug-ins or ad blocking software that help you block third party cookies. If you opt-out of interest-based advertisements, you will still see advertisements online, but they may be less relevant to you.

Some of the third party advertising companies we work with offer their own opt-out options that you can use to limit their use of your information for interest-based advertising, including Google (info and opt-out) and Facebook (info and opt-out). Please note that we also may work with companies that offer their own opt-out mechanisms or do not participate in the opt-out mechanisms described above. Even after using these opt-out mechanisms, you may receive interest-based advertising from other companies.

4.7.        Declining to provide information. We need to collect personal information to provide certain services. If you do not provide the information requested, we may not be able to provide those services.

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from the risks presented by unauthorized access or acquisition, we cannot guarantee the security of your personal information.

  1. OTHER SITES AND SERVICES

The Platform may contain links to other websites, online services, trips, and promotions operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or online services that are not associated with us. We do not control third party websites or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use and sharing of your personal information. We encourage you to read the privacy policies of the other websites and online services you use.

  1. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

Halfdays is based in the United States of America, and we work with service providers in the United States and other countries, such as our shipping partners in countries where our customers reside. If you are from a country outside of the United States of America with laws governing data collection, use, and disclosure that may differ from U.S. law and you provide personal information to us, please note that any personal information that you provide to us may be transferred to the United States of America and other countries where we or our service providers operate. By providing your personal information, where applicable law permits, you hereby specifically and expressly consent to such transfer and processing and to the collection, use, and disclosure as set forth in this Privacy Policy and in any applicable related terms of service.

  1. CHILDREN

The Platform is not intended for use by anyone under the age of 18, and we do not knowingly collect personal information from children. If you are a parent or guardian and you are aware that your child has provided us with personal information online, please contact us using the information in the below “CONTACTING US” section. If we become aware that we have collected personal information from children without verification of parental consent as required by law, we take steps to remove that information from our servers.

  1. NOTICE TO CALIFORNIA RESIDENTS

This section applies only to California residents. It describes how we collect, use, sell, share, and retain personal information of California residents when we act as a “business” as defined under California privacy laws, and their rights with respect to their personal information. For purposes of this section, “personal information” has the meaning given under California privacy laws but does not include information exempted from the scope of such laws. In some cases, we may provide a different privacy notice to certain categories of California residents, in which case that notice will apply instead of this section.

Personal Information We Collect, Use, and Disclose.

The personal information we collect, or have collected in the 12 months preceding the “Last Updated” date of this Privacy Policy, includes identifiers (such as contact details), commercial information (such as account information, communications, preferences, survey responses, order information, payment and transactional information), online identifiers (such as IP addresses or other IDs), internet or network information (such as device data or online activity data), inferences (such as inferences we make based upon past purchases), professional or employment information (such as job application information, including any education information you provide), and sensory information (such as posts, reviews, and other content that contain videos or images). More information about the categories we collect, including the sources from which we collect such personal information, is available in the “COLLECTION OF PERSONAL INFORMATION” section above.

The specific business or commercial purposes for which we collect this personal information is described in the section above titled “USE OF PERSONAL INFORMATION.” The categories of third parties to whom we disclose this personal information is described in the section above titled “SHARING OF PERSONAL INFORMATION.”

To the extent we collect sensitive personal information (as defined under California law), we only use or disclose it for purposes permitted under California law (e.g., to perform the Platform, detect security incidences and prevent fraud, and to verify and maintain the quality of the Platform). We do not collect or use sensitive personal information for the purpose of inferring characteristics about California residents.

Retention of Personal Information.

We will retain your personal information, including sensitive personal information, for as long as necessary to fulfill the purpose of collection, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish and defend legal claims, for fraud prevention purposes, or as long as required to meet our legal obligations. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

Personal Information Disclosed for Business Purposes, “Sold,” or “Shared”

In the twelve (12) months preceding the last update date of this Privacy Policy, we may have disclosed for a “business purpose” (as such term is defined in California law) each of the categories of personal information described above to the third parties listed in the section titled “SHARING OF PERSONAL INFORMATION” for the business purposes set forth in this Privacy Policy.

California law defines a “sale” as disclosing a California resident’s personal information to a third party for monetary or other valuable consideration. Where a disclosure is for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, it qualifies as “sharing” under California law. We may “sell” or “share” (and in the past 12 months have “sold” or “shared”) online identifiers and internet or network information to our advertising partners for purposes of advertising our products and services (including tracking the success of our advertising campaigns) and identifying new customers or potential customers. We do not knowingly sell or share the personal information of California residents under 16 years of age. Your Rights as a California Resident.

In addition to the choices enumerated under the “YOUR CHOICES” section above, California privacy law provides California residents with the rights listed below. Please note, these rights are not absolute, and, in some cases, we may not be able to respond to your request, such as when a legal exemption applies or if we are not able to verify your identity.

  • Right to Know/Access. You have the right to request that we disclose certain information to you about our collection and use of your personal information, including:
    • The categories of personal information we collected about you;
    • The categories of sources from which that personal information was collected;
    • Our business or commercial purpose for collecting, selling, or sharing (as applicable) that personal information;
    • The categories of third parties with whom we disclose that personal information (as applicable); and

  • Right to Delete. You have the right to request that we delete any of your personal information that we have collected from you and retained, subject to certain exceptions.
  • Right to Correct. You have the right to request that we correct inaccurate personal information that we maintain about you, taking into account the nature of the personal information and the purposes of the processing of the personal information.
  • Right to Opt-Out of Sales/Sharing. If we “sell” or “share” your personal information according to California law, you have the right to opt-out.
  • Right to Nondiscrimination. You are entitled to exercise the rights described above free from discrimination in the form or legally prohibited increases in the price or decreases in the quality of our products and services.

Do Not Sell or Share My Personal Information .

You can also broadcast the global privacy control (GPC) signal when visiting the Site. Note that due to technological limitations, if you visit our Site from a different computer or device, or clear cookies on your browser that store your preferences, you will need to return to select your preferences through our cookie preference manager or rebroadcast the GPC signal.

In addition, if you direct us not to sell/share your personal information, we will consider it a request pursuant to California’s “Shine the Light” law to stop sharing your personal information covered by that law with third parties for their direct marketing purposes.

When exercising your rights, or when otherwise assisting you, we may need to request specific information from you to help us confirm your identity. This is a security measure to, for example, ensure we do not disclose personal information to any person who is not entitled to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

You may also designate an authorized agent to make a request on your behalf. If you do so, we may require your proof of identification, the authorized agent’s proof of identification, and any other information that we may request in order to verify your request, including evidence of valid permission for the authorized agent to act on your behalf.

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee or decline to comply with your request if your request is unfounded, repetitive, or excessive.

We try to respond to all legitimate requests to know/access, delete, and correct within 45 days of your request. We try to respond to all legitimate requests to opt-out or limit the use or disclosure of sensitive personal information  within 15 days of your request. Occasionally it may take us longer than those timeframes to respond, for instance if your request is particularly complex or you have made a number of requests. In this case, we will notify you of the delay, and may continue to update you regarding the progress of our response.

  1. NOTICE TO NEVADA RESIDENTS

Nevada Revised Statutes Chapter 603A allows Nevada residents to opt-out of the “sale” of certain types of personal information. Subject to several exceptions, Nevada law defines “sale” to mean the exchange of certain types of personal information for monetary consideration to another person. If you are a Nevada resident who wishes to exercise your “sale” opt-out rights, you may submit a request to us using the contact information listed at the end of this Privacy Policy.
